Affidavit of service filed in court today is taken on record.

It is submitted that all the respondents have been served.

The State respondents are represented;

however, none appears for the respondent no. 6. This writ petition alleges inaction on the part of the respondent State Authorities in taking steps for removal of encroachment on Government land.

Learned Advocate appearing for petitioner invites the attention of this Court to a copy of the record of rights which forms annexure P/3 to the writ petition (at page 15 thereof) and submits that the subject land has been recorded in the name of the Collector, Government of West

Bengal. It is submitted that the same has been unauthorizedly occupied by the respondent no. 6 and despite representation in such regard having been made no step has been taken by the State respondents.

Learned Advocate appearing for respondent State Authorities hands up to court a copy of the enquiry report dated January 6, 2026 prepared by the Revenue Inspector Jalpai G.P.-01 and submits that upon enquiry it has been found that a 'Kutcha House' has been constructed by the respondent no. 6 over the subject land which is recorded in favour of the Irrigation Department of the Government of West Bengal.

The said report is taken on record.

Having heard the learned Advocates appearing for the respective parties, it is prima facie evident that there has been encroachment of Government/Public Land.

In such view of matter, respondent no. 3 ie., Sub-Divisional Officer, Haldia is directed to initiate appropriate proceedings under the relevant provisions of the West Bengal Public Land(Eviction of Unauthorized Occupants )Act, 1962 and take the same to their logical legal conclusion by passing a reasoned order upon hearing all interested

parties including the petitioner and the respondent no. 6 herein.

Such proceedings shall be concluded as expeditiously as possible and preferably within a period of eight weeks from date of communication of this order.

WPA 29444 of 2025 stands disposed of with the above observations.

However, there will be no order as to costs.
