Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is a sales manager of Bandhan Bank. He has been falsely implicated in this case. It is alleged that the petitioner was instrumental in verifying the documents and opening a mule account in the second layer so that the tainted money could be routed into such account. Notices were issued to the petitioner, and the petitioner has complied with the same. The principal accused and the alleged main mastermind in this case namely, Vikki Sharma @ Ashish Sharma, and some other coaccused, who were allegedly more actively involved have already been arrested.
Learned Additional Public Prosecutor representing the State strongly opposes the prayer for anticipatory bail. He relies on the statements of the two individuals, one of whom is an accused
who stated that the petitioner was instrumental in giving training to them.
The other witness, whose account if used, would have stood in shoes of a co-accused.
It appears that the principal accused in this case, the main mastermind has been arrested and some other co-accused have already been arrested.
A charge sheet has also been submitted.
Considering the above, the other materials available in the case diary, the alleged role ascribed to the present petitioner, the fact that the petitioner has cooperated with the investigation by answering to the notices issued and the fact that charge sheet has already been submitted, I am inclined to grant anticipatory bail to the present petitioner.
Accordingly, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of Arresting Officer and subject to the conditions as laid down under Section 438 of the Code of Criminal Procedure, corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita and on further condition that the petitioner shall not threaten or intimidate witnesses or tamper with evidence in any manner whatsoever and shall surrender before the learned jurisdictional Court and pray for bail within four weeks from this date and shall not leave the country without prior permission of the said jurisdictional Court.
The application for anticipatory bail is, thus, disposed of.
The personal appearances of the Investigating Officers are noted and are dispensed with.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
