Sk. Raj Ali v. The State Of West Bengal

2026-01-21Hon'Ble Justice Jay Sengupta2 pages

AD 80 January 21, 2026 Ct. 28 SG CRM(A) 4358 of 2025 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Panskura P.S. Case No.266 of 2025 dated 19.03.2025 under Sections 80/85/108/3(5) of the BNS, 2023. And In the matter of:

Sk. Raj Ali ... petitioner Mr. Saibal Mondal Ms. Sonali Ghosh ... for the petitioner Mr. Bidyut Kumar Roy, Sr. Adv.

Mr. Tirthankar Dhali ... for the State Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. The alleged victim was having some psychiatric issues. The incident happened within a year of marriage. The petitioner was working at a different place. Two other co-accused were granted anticipatory bail by this Court.

Learned counsel for the State strongly opposes the prayer for anticipatory bail and refers to the statements of witnesses including neighbours. He also points to the postmortem report and submits that the incident happened within a year of marriage. The petitioner was residing at the same place. The two other co-accused who were granted bail, were standing on a completely different footing. They were the uncles-in-law of the alleged victim.

Considering the above, the other materials available in the case diary, the alleged role ascribed to the petitioner, who is the husband of the alleged victim, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
