1. This revisional application has been filed under Article 227 of the Constitution of India against an order dated September 01, 2023 passed by the learned 3rd Judicial Magistrate at Contai in case no.Misc (DV) 84 of 2023 under Section 12 of the Protection of Women from Domestic Violence Act, whereby the interim order was refused.

2. The learned advocate representing the opposite party no.2 raises objection in view of the bar stipulated under Section 29 of that Act. The petitioner, instead of invoking such jurisdiction, has opted for filing this application under Article 227 of the Constitution of India. It is prima facie not maintainable since no other ground has been mentioned before this Court. That apart, the matter was sent for mediation which has failed.

3. In view of the above, this revisional application is dismissed being not maintainable. Liberty is given to the

petitioner to file appropriate appeal before the appropriate forum.

4. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.

5. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities.
