Learned advocate appearing for the petitioner is aggrieved by the manner in which the proceedings under Section 138 of the Negotiable Instruments Act are progressing in respect of Complaint Case No. 829 of 2018 before the learned Judicial Magistrate, 2nd Court, Barasat. Learned advocate submits that the dates are being fixed almost once in every six months. As such, there is hardly any progress in the merits of the case and till date further cross-examination of the complainant is continuing.

Having regard to the fact that the proceedings were initiated in the year 2018 and five years have passed since institution of the case, I direct that the learned Judicial Magistrate on and from the next date would fix one date on each and every 45 days so that trial of the case can be taken to its logical conclusion within a reasonable period of time. It would be in the wisdom of the learned Judicial Magistrate that trial of the proceedings is concluded and the verdict be pronounced by 31.12.2025.

With the aforesaid observations, the revisional application being CRR 4836 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
