Kausik (Rejected) CRM (NDPS) 1704 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with English Bazar Police Station Case No. 328 of 2024 dated 08.03.2024 under Sections 21(C)/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that petitioner has been arrested for recovery of 125 bottles of Phensedyl and is in custody since 08.03.2024. Learned advocate for the State opposes the prayer for bail and submits that out of 11 witnesses, 10 witnesses have already been examined and the date for examination for next witness is fixed on 6th and 7th February, 2026. Having regard to the final stage of the trial I am not inclined to release the petitioner on bail.

Accordingly, CRM (NDPS) 1704 of 2025 is dismissed.
