Learned advocate appearing for the State submits a report wherefrom it reflects that the Scorpio vehicle which has been the subject matter of Arambagh Police Station Case No. 571 of 2024 has been seized.

Petitioner claims to be the owner of the vehicle while respondent nos. 9 & 10 submits that on misrepresentation by the respondent no. 8, he was deceived to purchase the vehicle.

Accordingly if the vehicle is returned to the petitioner he has no objection.

Be that as it may, the learned ACJM, Arambagh is in seisin of Arambagh PS Case No. 571

of 2024 dated 04.10.2024. The next date as has been submitted by the parties is on 07.02.2025.

The Inspector-in-Charge, Arambagh Police Station is directed to submit the report before the learned ACJM, Arambagh, in the alternative the learned ACJM, Arambagh would ensure the report be reached in connection with the return of the seized vehicle on 07.02.2025.

On application of mind the learned ACJM, Arambagh if he deems fit and proper would consider the plight of the present petitioner and decide as to whether during the pendency of the proceedings, the vehicle can be returned to the present petitioner. With the aforesaid observations WPA 29470 of 2024 is disposed of.

Report so submitted be kept with the record.
