This instant appeal is preferred at the behest of appellant-convict challenging the impugned judgement and order dated 09.4.2015/10.4.2015 passed by the learned Trial Court, in connection with Sessions Trial No. 2 (8) of 2004 convicting the accused appellant under Section 366 of the Indian Penal Code and was sentenced to suffer 07 (Seven) years rigorous Imprisonment for the offence committed under Section 366 of the Indian Penal Code alongwith fine in default to R.I. for 01 (One) month.

It appears from the order passed by the Court dated 9.6.2022, wherein, the learned Chief Judicial Magistrate, Barasat, was directed to submit a report as to whether, the appellant-convict has served full term of imprisonment as sentence, but no report has been received from the learned Chief Judicial Magistrate, Barasat, till date. 5.

Department is directed to obtain a report regarding compliance of the direction passed by this Court dated 29.6.2022 from the learned Chief Judicial Magistrate, Barasat, before the next date of hearing. 6.

It appears that Mr. Pinak Mitra, learned Counsel appeared on behalf of the appellant on earlier occassion.
