3. A report submitted by the Superintendent, Dum Dum Central Correctional Home is handed over by the learned Advocate for the State during course of hearing.

4. The report submitted by the Superintendent, Dum Dum Correctional Home indicates that the convict/appellant had completed her term of sentence after setting off the under trial period w.e.f. 09.04.2015 and getting benefit of Remission for a period of 391 days, i.e. 01 year 01 Month and 01 day. After completion of the sentence she had to suffer 01 month more for non-payment of fine, and finally she released from the Correctional Home on 07.04.2021. The report submitted by the Superintendent, Dum Dum Correctional Home be kept with the record.

5. As the appellant/convict had already served out the sentence as passed by the learned Trial Court in the

impugned judgment and order of conviction, the present appeal becomes infractuous.

6. Accordingly, the instant appeal being CRA 757 of 2015 be and the same is hereby dismissed affirming the impugned judgment and order of conviction passed by the learned Trial Court dated 09.04.2015 and 10.04.2015 in connection with Sessions Trial No. 02(8) of 2004.

7. Thus, the instant appeal be and the same is hereby disposed of.

8. Let a copy of this order along with the Trial Court Records be sent down to the Trial Court immediately.

9. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
