Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and has been falsely implicated in connection with the instant case on alleged recovery of 131.30 kgs. of ganja.

Learned advocate appearing for the NCB, on the other hand, opposes the prayer for bail and produces the case diary.

I have taken into account the manner in which the petitioner was available when the recovery was made from the vehicle. Having considered the quantum of seizure of contraband in the present case, I am of the view that the provision of Section 37 of the NDPS Act is attracted. As such, at this stage, the prayer for bail of the petitioner is rejected.

However, the learned Trial Court is directed to examine the seizure list witnesses in the present case on priority. Petitioner would be at liberty to approach this Court after the evidence of seizure list witnesses is over. The application for bail, being CRM (NDPS) 1720 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
