Petitioner(s) Mr. Krishnendu Bera ... for the Petitioner(s) Mr. Saptarshi Chakraborty ... for the State-respondent(s) Learned advocated for the petitioner submits that the subject-matter of the case relates to recovery of 25.193 kgs. of ganja from two persons including the present petitioner and the petitioner is in custody for about eight months.
According to the learned advocate, although charges have been framed, there is no possibility of the trial concluding in the near future, as such, on any stringent condition the petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail but do not dispute regarding the quantum of seizure made in connection with the instant case.
Having regard to the period of detention of the present petitioner, I am of the view that further detention of the present petitioner is unwarranted.
Hence, the prayer for bail of the petitioner is Allowed.
Accordingly, the petitioner, namely Jayanta Sarkar shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court (NDPS Act)-cum-Additional Sessions Judge, 12th Court, South 24 Parganas.
If on bail, the petitioner shall make himself physically available on each and every date so fixed by the learned trial court and shall not leave the jurisdiction of the district of South 24 Parganas without prior permission of the learned trial Court.
Accordingly, CRM(NDPS) 1708 of 2025 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
