The petitioner prays for a direction upon the respondent authorities to demolish the unauthorized construction made at the behest of the private respondents.

It appears that the matter was taken up for consideration by the Howrah Zilla Parishad and the same has been relegated to the Domjur Panchayat Samity for taking a final decision in the matter. Learned advocate representing the Domjur Panchayat Samity submits, upon instruction that, notice

has been served upon all the necessary parties for appearing in the hearing scheduled on April 22, 2024. The Panchayat Samity is directed to decide and conclude the issue of unauthorized construction in accordance with law at the earliest but positively within a period of twelve weeks after the hearing is conducted on April 22, 2024.

It will be open for the Panchayat Samity to cause fresh spot inspection upon prior notice to all the necessary parties to ascertain the exact nature and extent of unauthorized construction and circulate the spot inspection report amongst the parties.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
