Kausik (Rejected) CRM (NDPS) 1710 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Ratua Police Station Case No. 71/2025 dated 02.02.2025 under sections 18(b) of the NDPS Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for almost a year and till date although charge sheet has been submitted but no steps have been taken for the progress of the trial.

Learned advocate also questions regarding the seizure and weighment which has been shown in the present case for recovery of the opium/poppy plants.

Learned advocate for the State has produced the attachment order in respect of the plants which have been cultivated in 317 Sq. Ft. of land.

I have taken into account the quantum of seizure and the factum of detention of the present petitioner. It has been

informed that the next date is fixed for consideration of charges.

Accordingly, at this stage, I am not inclined to release the petitioner on bail.

Petitioner will renew his prayer for bail after the evidence of the seizure list witness is over. Thus, CRM (NDPS) 1710 of 2025 is rejected at this stage.

Learned advocate for the State would communicate this order to the learned Trial Court.
