The contempt application is not maintainable. C.O. 3000 of 2023 arose out of an order dated July 18, 2023, passed by the learned Additional District Judge, 1st Court at Contai, Purba Medinipur in J. Misc. Case No.62 of 2022.

The husband was directed to pay Rs.1,00,000/- as maintenance pendente lite from the date of the filing of the application till the disposal of the matrimonial proceeding. Such order was challenged before this Court and the Court modified the order thereby directing the husband to pay Rs.45,000/- per month as maintenance pendente lite to the wife and Rs.33,000/- per month as maintenance pendente lite to the child, from the date of the application, till the disposal of the suit.

It is contended by the applicant that the said order has not been complied with. The remedy of the applicant is not before this Court in a contempt proceeding. The applicant has other remedy available under the law and may proceed accordingly.

Accordingly, the contempt application is disposed of. Contempt proceedings are dropped.

Parties are directed to act on the basis of the server copy of this order.
