The affidavit-of-service filed by the learned advocate for the petitioner be kept with the record.

2. The petitioner participated in 2nd SLST in the subject Agriculture. He secured 43 marks. The cut off for the subject is 51 marks.

3. Submission is that as there are vacancies yet to be filled up, the authority ought to reduce the cut off marks so that the vacancy can be filled up.

4. The petitioner relies upon the order passed by this Bench on January 6, 2026 in WPA 29898 of 2025 (Subhankar Das & Ors. vs. The State of West Bengal & Ors.) wherein under similar circumstances, this Court directed the respondents to file opposition in the matter.

5. Prayer has been made to direct the respondents to file affidavit-in-opposition disclosing their stand.

6. Learned advocate representing the Commission opposes the submission of the petitioner. It has been submitted that there is no scope to grant any opportunity to the petitioner for participating in the process of credential verification.

7. Upon hearing the submission made on behalf of the parties, it appears that the petitioner is way below the cut off marks in the subject. If any suitable candidate is not available, then the vacancy will be filled up in the matter as prescribed in law.

8. The Court is not inclined to pass any order for bringing down the cut off marks so that the petitioner may be accommodated. If the submission of the petitioner is to be accepted, then the standard of the subject will be compromised.

9. The Court is not inclined to pass any order in the instant writ petition.

10. The writ petition fails and is hereby dismissed.

11. All the parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

12. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
