21.02.2024 SL No. 25 Ct No. 29 SB C.R.M. (A) 5619 of 2023 In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Kushmandi P.S. Case No. 216 of 2023 dated 28.08.2023 under Section 363/365 of the Indian Penal Code.

And In the matter of: Golam Rabbani ....Petitioner Mr. Mazahar Hossain Chowdhury ...for the Petitioner Md. Anwar Hossain Md. Kutubuddin ...for the State Report as called for by the order dated 13.02.2024 filed in court be taken on record.

Report states that the Investigating Officer spoke to both the victim as also the petitioner and that individually, they denied that they are married to each other.

Victim recorded a statement under Section 164 of the Cr.P.C. implicating the petitioner before us in kidnapping and rape.

Consequently we are unable to grant anticipatory bail to the petitioner.

Accordingly the application for anticipatory bail is rejected.
