Report filed on behalf of the State is taken on record. ssi Ct. 17 Learned counsel appearing on behalf of the petitioner submits that the petitioner is aggrieved with the disconnection of electricity in respect of a commercial connection. The petitioner wants to pay 50 % of the provisional assessment and seek restoration of electricity. The final order of assessment has been passed on 02.12.2024.

Learned counsel appearing on behalf of the respondent CESC authorities denies the allegations and submits that payment of 50 % of the provisional assessment would only entitle them to prefer an appeal before the competent authority.

In view of the above, the writ petition is disposed of by

granting liberty to the petitioner to prefer an appeal upon payment of 50 % of the provisional assessment within a week from this date.

The Appellate Authority shall hear out the matter in accordance with law as expeditiously as possible, preferably within four weeks from the date of filing of the appeal. Parties shall act on a server copy downloaded from the official website of this Court.
