Application filed by the petitioners seeking cancellation of the sanctioned building plan being No. 63/2021-22 approved by the Contai Municipality on 4th June, 2021 is pending consideration at the end of the Contai Municipality.

Without going into the merits of the said application as it appears that the same is pending consideration for a considerable period of time, accordingly, the instant writ petition is disposed of by directing the Municipality to take into consideration the legal representation dated 30th November, 2023 in accordance with law, after giving a reasonable opportunity of hearing to all the necessary parties for

production of documents in support of their respective stand. A reasoned order shall be passed and communicated to the parties immediately thereafter. If any consequential step is required to be taken, the same shall be taken by the Municipality.

Steps shall be taken in the matter at the earliest, but positively within a period of twelve weeks from the date of communication of this order.

Learned advocate appearing for the petitioners is directed to forward a copy of the legal representation dated 30th November, 2023 to the aforesaid respondent at the time of communicating the order of the Court. The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
