1. Matter is heard in presence of the learned advocates representing the petitioner and Union of India.

2. It is submitted by the learned advocate representing the petitioner that petitioner is working as Constable under Indo-Tibetan Border Police Force and was dismissed from service vide order dated 10th October, 2025.

Petitioner prays for direction for reinstatement with back wages.

3. On perusing the documents available on record it appears that entire proceeding was initiated by the concerned authority of IndoTibetan Border Police Force, outside the territorial jurisdiction of High Court at Calcutta.

Petitioner may have been residing in West Bengal but show cause letter dated 8th September, 2025 was issued by Commandant, 47th Battalion, Indo-Tibetan Border Police Force from outside the jurisdiction of this Court and final order of punishment thereby dismissing the petitioner from service was also issued by Commandant, 47th Battalion, IndoTibetan Border Police Force whose office does not situate within State of West Bengal.

Therefore, it transpires that entire proceeding was initiated against the petitioner by the disciplinary authority whose office does not situate within the jurisdiction of High Court at Calcutta.

5. Therefore, it is found that writ petition is not maintainable before this Court having no territorial jurisdiction.

6. Hence, writ petition stands dismissed.

7. However, this order shall not preclude the petitioner to take steps in accordance with law by approaching the appropriate forum having jurisdiction.

8. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
