Petitioners approached this Court being aggrieved 23.04.2025 Court No. 35 Item No.19 Rakib that the police authorities were not taking effective steps. According to the petitioners in course of the investigation during the interregnum between the month of December, 2024 and the month of April, 2025 one of the accused persons was arrested. Subsequently, there were some commitments which have materialized.

On the other hand learned advocate appearing for the petitioners submit that the accused after being arrested was produced before the learned ACJM, Alipore and at the time of consideration of the bail application, according to the learned advocate the accused committed to handover post-dated cheque but after obtaining the interim bail till date has not handed over the cheque and defied the commitments made before the learned ACJM, Alipore also.

Since the investigation of the case is in progress, the primary grievance of the petitioner for approaching this Court has been subserved. So far as the failure of

commitment or undertaking given before the learned ACJM is concerned, petitioner would be at liberty to take up the issue either by preferring cancellation of bail or by taking out an appropriate application for committing fraud upon the Court.

In view of the primary grievance for which the petitioner approached this Court being subserved, I am of the view further pendency of the writ petition is unwarranted. However the investigating officer will take the investigation of the case to its logical conclusion within a reasonable period of time.

With the aforesaid observations, WPA 29549 of 2024 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
