Learned counsel for the petitioner submits that the FIR in connection with GR Case No. 692 of 2024 was lodged on 31st July, 2024 and the charge-sheet has been submitted against the petitioner on 15th October, 2025. However, three FIR named accused persons have been discharged.

The main grievance ventilated herein by the petitioner is that after submission of the charge-sheet court below has not yet taken any decision in respect of the same, therefore he prayed for a direction for taking expeditious decision upon the same. Having heard learned counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and if it is disposed of in terms of the prayer made in the petition, the opposite party/State will have no cause to prejudice. As such, service of copy of application upon the opposite party is dispensed with.

Having heard learned counsel for the petitioner, it appears from the order dated 15th October, 2025 that the court below received the charge-sheet against the petitioner under section 420 of the IPC but since the investigating officer had prayed for discharge of three other accused persons the court below directed

to issue notice upon the defacto complainant namely S.I. Ayan Das for hearing before taking decision about proceeding further. I am appraised that next date is fixed on 30th January, 2026 for taking decision by the trial court regarding cognizance. Having heard learned counsel for the petitioner and that the prayer made on behalf of the petitioner is justified, the court below is directed to take decision upon the charge-sheet on the date fixed or preferably within a period of thirty days thereafter. CRR 5507 of 2025 is accordingly disposed of.
