16.6.2023 ct. 236 sk,sl.21 C.O. 3344 of 2014 Soumen Majumder-vs-Rabindra Bhusan Sengupta & Ors. .

Mr. Rishav Manna .....for the petitioner.

Heard Mr. Rishav Manna, learned counsel for the petitioner perused the order impugned.

Affidavit of service is taken on record.

It is contended by learned counsel for the petitioner that the plaintiff-opposite party by filing an application under Order 6 Rule 17 of the Code of Civil Procedure intended it to incorporate certain events that took place subsequent to the filing of the suit. The prayer was allowed by learned trial court by the impugned order.

I do not find any reason to hold that there was failure on the part of learned trial court to exercise jurisdiction vested in it.

The order impugned does not merit any interference. This revisional application stands dismissed. Let a copy of this order be sent down to the learned trial court forthwith.
