Mr. Ashis Kumar Chowdhury Mr. Babhru Bahan Bera ....for the petitioner Affidavit of service filed in Court today is taken on record.

The learned advocate appearing for the petitioner submits that the respondents have been duly served. In spite of service none appears for the respondents. The petitioner claims that the property of the petitioner being Dag No.800, Khatian No.1606, J.L. No.138 within Mouza-Mayureswar under Police StationMayureswar-II in the District of Birbhum was initially requisitioned under the provisions of Section 3 of the West Bengal Land (Requisition and Acquisition) Act, 1948 and subsequently the same was acquired upon issuance of a notice under Section 4(1a) of the said Act.

The learned advocate appearing for the petitioner submits that the said property has not been utilised for the purpose for which the same was acquired and the respondent authorities have taken a decision to return the unutilized land to the owners. The petitioner claims to have submitted a representation dated August 7, 2024

before the Collector, Birbhum, being the respondent No.5, praying for return of the land of the petitioner. The learned advocate for the petitioner submits that no decision on such representation has been communicated to the petitioner till date.

Without entering into the merits of the claim made in the representation dated August 7, 2024, WPA 29565 of 2024 stands disposed of by directing the Collector, Birbhum, being the respondent No.5, to consider the representation of the petitioner dated August 7, 2024 and to dispose of the same by passing a reasoned order after giving an opportunity of hearing to the petitioner or his authorised representative and communicate the reasoned order to the petitioner immediately thereafter. The entire exercise shall be completed by the respondent No.5 as expeditiously as possible but preferably within a period of 8 weeks from the date of receipt of a server copy of this order along with a copy of the representation dated August 7, 2024.

There will be no order as to costs.
