ct.no.35 W.P.A.29617 of 2024 Lokesh Kantal
Versus
Union of India & Ors.
Mr. Kunal Ganguly Mr. Shraman Sarkar.
...for the petitioner.
Mr. Debangshu Dinda.
...for the State-respondents.
Mr. Debashis Saha Mr. Avirup Roy Sanyal Ms. Sucheta Pal.
...for the respondent/bank.
I have considered the case diary produced by the learned advocate appearing for the State and also heard the version of the State Bank of India, the respondent bank.
Having considered that the police authorities have investigated the case and located the beneficiaries, I am of the view that further interference of this Court is unwarranted in the facts and circumstances of the case. Petitioner, if so advised, will prefer an application for supply of copies relied upon by the prosecution before the learned CJM, Howrah and on perusal of the same if there is any dissatisfaction, petitioner would be at liberty to take out an appropriate application under Section 173(8) of the Code of Criminal Procedure.
With the aforesaid observations, WPA 29617 of 2024 is disposed of.
There will be no order as to costs.
Case diary be returned to the learned advocate appearing for the State.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
