The State of West Bengal and others Mr. Abhra Jena Mr. Swarnadeep Khara Mr. Devang Das ... for the petitioner Mr. Vimal Kumar Shahi Ms. Pratiti Das ... for the State The petitioner alleges that the private respondents are threatening and creating circumstances for which information has been sent to Baguiati Police Station but the same police station instead of acting on such information are responding to the information/complaint submitted by the private respondents. The petitioner also complains that his mother-in-law as well as his wife has been threatened during pendency of the criminal case. State submitted a report which reflects that Baguiati Police Station Case No.691/2024 dated 25.11.2024 has been registered for investigation, on the basis of the information furnished by the petitioner. Secondly, on the basis of the complaint of the petitioner, another case being Baguiati PS Case No.568/2024 dated21.09.2024 was registered for investigation. Another case was registered on the basis of the information furnished by the private respondents.

Prima facie, from the report of the police authorities, it reflects that petitioner and the private respondents are known to each other and there was a dispute between them from which criminal case arises as also registered for investigation. Presently the grievance of the petitioner is restricted to threats and abusive language being used against his wife and the mother-in-law. To that extent, petitioner can approach the appropriate authority under the Witness Protection Scheme, 2018, since criminal case is pending. The appropriate authority will direct the police authority to assess regarding the threat perception and accordingly steps be taken by the courts in session of the criminal case. In the meantime, the police will keep vigil so that no untoward incident takes place.

With the aforesaid observation, WPA 29577 of 2024 is disposed of.

The report submitted be kept with the record. Copy of the report be handed over to the learned advocate for the petitioner.

All the parties shall act on the basis of the server copy of the order.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
