Heard learned counsels for the parties.

Pursuant to an order passed by this Court on 21st November, 2022 in WPA 24283 of 2022, proceeding under Section 10 of the West Bengal Highways Act, 1964 was initiated against the private respondent herein and concluded by an order passed under Section 10(3) of the Act.

Learned counsel for the petitioner submits that the private respondent has preferred an appeal against the said order under Section 10(4) of the Act which is still pending. The petitioner seeks expeditious disposal of the said appeal.

Upon consideration of the submission made on behalf of the parties, the writ petition is disposed of directing the 2nd respondent to consider and dispose of the

appeal preferred by the private respondent under Section 10(4) of the Act of 1964 within six weeks from the date of communication of this order, in accordance with law. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
