1. Report filed on behalf of the State is taken on record.

2. Learned counsel appearing on behalf of the petitioner submits that other than the statement of a co-accused, there is no other incriminating material available against the petitioner.

3. Learned counsel appearing for the State opposes the prayer for anticipatory bail. As per the FIR, the petitioner was present along with the other accused at the spot and managed to flee away. Other than that there are phone call records showing conversation between the petitioner and the principal accused, made through his wife's phone. There are also criminal antecedents of the petitioner, out of which two cases are under the NDPS Act.

4. Considering the above and the other incriminating materials available in the case diary and the fact that there were phone call conversations between the petitioner and the principal accused, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

5. Accordingly, the application for anticipatory bail is rejected.
