The petitioner refers to the order passed by the learned ACJM, Basirhat dated 6th November, 2024, wherein, the learned ACJM observed that there are certain irregularities in the Case Diary, as such, directed the investigating officer to conduct the investigation diligently.

Learned advocate for the State

has submitted a report, which reflects that inter se the parties, three criminal cases are pending apart from the other case before the learned Executive Magistrate.

It has been informed that in respect of G.R. Case No. 4153 of 2024 corresponding to Basirhat P.S. Case No.

693 of 2024, a new investigating officer in the rank of Sub-Inspector of Police has been entrusted with the investigation of the case.

As the new investigating officer has been assigned the job of continuing with the investigation, the petitioner who happens to be the defacto-complainant must have patience for the investigating officer to collect the materials, assist, as also cooperate with him for the purposes of taking the investigation to its logical conclusion.

In spite of the same, if the

petitioner has any grievance, the petitioner would canvass the issues before the ld.

ACJM, Basirhat. It would be the discretion of the learned ACJM to act in accordance with law.

With the aforesaid observations, WPA 29605 of 2024 is disposed of.

Report so submitted be kept with the record. Let a copy of the report be handed over to the learned advocate for the petitioner.
