The said report encloses a declaration and a statement. The said declaration and the statement reflects that the complainant/Ritu Jhunjhunwala, is not willing to proceed with the criminal case, which is pending before the ld. CJM, Alipore in connection with Bhowanipore P.S. Case No. 226 of 2021.
The case arose out of matrimonial dispute and discord.
Hence, I am of the view that further continuation of the present proceedings pursuant to the compromise, is unwarranted.
Accordingly, all further proceedings of Bhowanipore P.S. Case No. 226 of 2021 dated 12.10.2021 under sections 498A/406/34o of the IPC (CGR No. 2956 of 2021) before the ld. CJM, Alipore, is hereby quashed.
With the aforesaid observations, CRR 4852 of 2023 along with CRAN 1 of 2023 is allowed.
Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
