Affidavit of service filed by the petitioner is taken on record.
None appears for the respondents despite service. Mr. Susovan Sengupta and Mr. Manas Kumar Sadhu who usually appear for the State and are present in Court, are requested to represent the State in this matter. Their appointment be regularised by the appropriate authority.
The petitioner is directed to serve copy of the writ petition along with annexure thereto upon Mr. Sadhu, in course of this day.
Report submitted by the State is taken on record. Learned counsel for the petitioner submits that the petitioner lodged a complaint against the private respondents which was registered as FIR and investigation is in progress. The private respondents were granted bail by the Additional Chief Judicial Magistrate (Bengal) in charge on 1st December, 2025 subject to condition that they would meet the Investigating officer of the case thrice a week for next two months, shall not enter the jurisdiction of the place of occurrence for next two months, shall not
communicate with the defacto complainant/victim or his family by any means whatsoever and would not be seen anywhere near the defacto complainant and his family members. Despite such order, the private respondents entered the place of occurrence on 2nd December, 2025 and brutally assaulted the petitioner and his wife. The petitioner lodged another complaint before the police authority which has also been registered and investigation has commenced. The petitioner seeks protection. Upon consideration of the submission made on behalf of the parties, this Court is of the view that the petitioner is at liberty to take necessary steps for cancellation of the bail of the private respondents before the appropriate forum.
In the meantime, the respondent no.3 shall take necessary steps to keep strict surveillance in the area in view of strained relationship between the parties and ensure that no untoward incident occurs and law and order is maintained. The police authority shall ensure strict compliance of the order passed by the learned Additional Chief Judicial Magistrate (Bengal) in charge. Other prayers in the writ petition have not been pressed by the petitioner.
The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.
