Banerjee) ... petitioners Ms. Dipanwita Das ... for the petitioners The petitioners have challenged the continuation of the proceeding of Hirapur Police Station FIR no. 94 of 2023 wherein the police authorities, after completing the investigation have submitted charge-sheet under Sections 341/323/324/34 of the Indian Penal Code. I find in report under Section 173 Cr.P.C. a doctor has been cited as a charge-sheeted witness. None of the documents under Section 207 of the Cr.P.C. have been enclosed and the learned advocate submits that the petitioners are yet to receive the same.

Having considered the stage at which the petitioners approached this court, I am of the view that the revisional application is premature.

The petitioners are granted liberty to take up the issues canvassed in the revisional application at the stage under Section 239 Cr.P.C. after receipt of the documents under Section 207 Cr.P.C.

Needless to state that the learned Magistrate considering the application will independently decide the

issue on merit without being influenced by any observation made by this court.

With the aforesaid observation, CRR 4854 of 2023 is disposed of.
