Petitioner has challenged the proceedings relating to Samserganj Police Station Case No.155 of 2022 dated 07.05.2022. The investigating agency on conclusion of investigation has submitted charge-sheet under Sections 448/323/427/354/34 of the Indian Penal Code. The petitioner is yet to receive the documents under Section 207 of the Code of Criminal Procedure. Accordingly, I direct the petitioner to take out an application in the nature of Section 239 of the Code of Criminal Procedure before the learned Magistrate after receipt of the documents under Section 207 of the Code of Criminal Procedure. Learned Magistrate/trial court is directed to dispose of the application, if any filed under Section 239 of the Code of Criminal Procedure in accordance with law without being influenced by any observations made by this Court.

With the aforesaid observations, CRR 4859 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.
