The subject matter of the revisional application relates to an order dated June 16, 2023 whereby the petitioner challenges the issuance of proclamation and attachment passed by the learned CJM, Purba Midnapore, Tamluk in connection with Nandakumar Police Station Case No.163 dated May 4, 2022. Mr. Nandy, learned advocate appearing for the State has submitted a report which reflects that proclamation as well as attachment has been executed. There are seizures in respect of certain properties of the present petitioner. Subsequently, all efforts have been exhausted. The petitioner was declared as an absconder and steps have been taken by the concerned Police Station according to the police Act for registering the name of the persons in the absconder list.
Report submitted by the State be kept with the record.
Having considered the stage at which the petitioner approached this Court, I am of the view that no interference can be made at this belated stage.
Mr. De, learned advocate appearing for the petitioner submits that the petitioner would surrender before the learned CJM, Purba Medinipore at Tamluk within a period of three weeks. Accordingly, the petitioner will meet the Officer-in-Charge of Nandakumar Police Station every alternate day till his surrender before the learned CJM, Purba Medinipore at Tamluk in connection with Nandakumar Police Station Case No.163 of 2022. The Officerin-Charge/Inspector-in-Charge of Nandakumar Police Station will not take any coercive steps till 27th February, 2024. If the petitioner do not surrender or attend the Police Station, this order would be deemed to be vacated.
With the aforesaid observations, CRR 4862 of 2023 is disposed of.
Pending connected application, if any, is consequently disposed of.
