1. Learned counsel for the petitioner submits that the petitioner has already filed an application under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 before the appropriate Tribunal. Hence, the petitioner wants to withdraw the instant writ petition.

2. Accordingly, W.P.A. No. 28393 of 2023 is dismissed as withdrawn.

3. There will be no order as to costs.

4. It is made clear that the merits of the contentions of the parties have not gone into this Court.

5. The concerned Tribunal will be at liberty to proceed with the matter independently without

being influenced in any manner by the present dismissal.

6. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
