1. Affidavit-of-service filed in Court today is taken on record.

2. The present writ petition has been filed, inter alia, praying for a direction upon the municipal authorities to forthwith demolish the unauthorized construction being carried out at premises No.9A, Madan Chatterjee Lane, Kolkata-700 002.

3. The private respondents are represented.

The respondent nos.9 & 10 has placed before this Court the sanctioned building plan duly approved on 16th October, 2023 by the municipal authorities pertaining to premises No.9A, Madan Chatterjee Lane, Kolkata-700 002, Ward No.25, Borough - IV. Let copy of the sanctioned building plan be taken on record.

5. In the light of the above, I am of the view, no useful purpose will be served in keeping the writ petition pending.

Since the petitioner has made a complaint/representation, the municipal authorities shall decide on the same by carrying out an inspection at the premises in question.

6. For the time being though the petitioner may be notified of the inspection, the petitioner may not be invited for inspection though the report thereof may be supplied to the petitioner.

On the basis of the aforesaid and the materials on record, the municipal authorities shall decide on the complaint/representation and if, illegal construction is noted, appropriate action in accordance with the provisions of the West Bengal Municipal Act, 1993 shall be taken. If on the contrary, no deviations are noted, the matter may not be proceeded further.

8. Since no affidavit-in-opposition is called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

9. The entire exercise must be complied with within a period of 4 weeks from the date of communication of this order.

With the above observations and directions, the writ petition stands disposed of 11.

All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Hon'ble Court.
