1. Learned counsel for the petitioner has placed a written instruction stating that the dispute between the parties has been settled and prays for withdrawal of the revisional application.

2. It is further submitted by the learned counsel appearing for the defendant/petitioner herein that an application under Order XXIII Rule 1 CPC is pending before the learned Trial Court for acceptance since 5th June, 2024.

3. Considering the delay on the part of the trial Court in accepting the petition of compromise the petitioner has approached the High Court. The petitioner now prays for necessary orders for consideration of the application under Order XXIII Rule 1 CPC.

4. The plaintiffs/opposite parties are not being represented today.

5. Considering the said facts, the civil revision is disposed of as 'withdrawn' with the direction to the learned trial Court being the learned Civil Judge (Senior Division), 3rd Court at Barasat or the Court-in-Charge, to hear the said application under Order XXIII Rule 1 CPC and decide the said issue of compromise, within 30 days from the date of this order.

6. Civil Revision stands disposed of.

7. Lower Court Records be sent down to the trial Court at once.

8. Connected application, if any, stands disposed of.

9. Interim order, if any, stands vacated.

10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
