More than one and half years have passed since then.

The grievance of the petitioners is for monetary assistance as also entering into their residence. One of the petitioners happens to be a senior citizen.

Having considered that the statutory provisions under the provisions of Welfare and Maintenance of Senior Citizens Act, 2007 is an alternative and efficacious remedy available to the senior citizens, the petitioners would be at liberty

to approach the appropriate authority under the said Act.

State has submitted a report which reflects that there has been family feud and, to that effect, proceedings have been drawn up under Section 107/116(3) of the Cr.P.C. at the relevant point of time.

Having considered the circumstances which were existing in September, 2023, I am of the opinion that if the same circumstance still exists, the petitioners would inform the Inspector-incharge of Karimpur Police Station, who would take steps in accordance with law.

If the petitioners are aggrieved by the inaction of the police authorities, then, in that case, they would approach the learned Magistrate under the relevant provisions of law. The learned Magistrate will conduct an enquiry as also assess whether any case for investigation and/or

issuance of process is made out, thereafter, pass necessary order(s)/direction(s) in accordance with law. With the aforesaid observations, WPA 28443 of 2023 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record.
