Report dated 04.04.2024 submitted by the learned advocate appearing for the State be kept with the record. The subject-matter of the revisional application relates to warrant of arrest being issued against the present petitioner by an order dated 09.10.2023 by the learned Judge Special 3rd Court, Malda under NDPS Act in connection with Kaliachak Police Station Case No.

764/2020 dated 05.10.2020. Having considered that the petitioner was not informed by the surety or the learned advocate representing him, I am of the view that a single opportunity must be granted to the petitioner. Accordingly, if the petitioner appears before the learned trial court in connection with Kaliachak Police Station Case No.

764/2020 dated 05.10.2020 by 30.04.2024, the learned Special Court would allow the petitioner to continue on the same bail and bond as was earlier furnished before that court. A condition be imposed that till further directions by the learned Special Court, the petitioner shall meet with an officer deputed by the Inspector-in-Charge, Kaliachak Police Station once in every ten days.

In case the petitioner do not appear or surrender by 30.04.2024, on 01.05.2024 the learned Special Court will be at liberty to resort to harsher process of law by adhering to the provision of Section 82 of the Code of Criminal Procedure. With the aforesaid observations, the revisional application being CRR 4866 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
