REJECTED C.R.M.(A) 5630 of 2023 In Re:- In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Mahishadal Police Station Case No. 563 of 2023 dated 02.09.2023 under Section 341/323/307/379/34 of the Indian Penal Code.

...... petitioners Mr. Abdur Rakib ...for the petitioners Mr. Saibal Bapuli Mr. Arup Sarkar ...for the State Apparently, the victim suffered simple injury in an incident of assault. Nonetheless, we are not inclined to grant anticipatory bail to the petitioners for the following reasons. The incident of assault revolved around demand of subscription for a community puja.

Granting anticipatory bail to the petitioner with regard to such incident will send a wrong signal to the society. In such circumstances, we are unable to grant anticipatory bail to the petitioner and the prayer for anticipatory bail is rejected.

The application being CRM (A) 5630 of 2023 is dismissed.
