The petitioner claims to have challenged the original order dated 11th November, 2014 and the order passed under review dated 10th May, 2016, both passed by the District Magistrate under the provisions of the West Bengal Minor Minerals Rules 2002 in an appeal before the Commissioner of Land, being the Appellate Authority under the West Bengal Minor Minerals Rules 2002.

The learned Counsel appearing for the petitioner submits that pursuant to an information sought under the Right to Information Act, 2005, the petitioner was requested to supply a copy of the appeal petition. He further submits that pursuant to such request, the petitioner has duly submitted a copy of the appeal petition dated 15th July, 2016 on 7th July, 2025 and thereafter again on August 26, 2025 before the Appellate Authority being the third respondent. The grievance of the petitioner is that till date, no date of hearing has been fixed by the Appellate Authority. Mr. Bose, learned Junior Standing Counsel appearing for the State submits that the appeal shall be

disposed of within the time limit as may be fixed by this Court.

In the light of the submissions made by the learned Advocates for the respective parties, WPA 29409 of 2025 stands disposed of by directing the Commissioner of Land, being the Appellate Authority under the West Bengal Minor Minerals Rules, 2002, i.e. the third respondent, to consider the appeal petition dated 15th July, 2016 filed by the petitioner herein and to dispose of the same in accordance with the law after giving an opportunity of hearing to the petitioner and other necessary parties and by passing a reasoned order, which shall be communicated to the petitioner immediately thereafter.

The entire exercise shall be completed as expeditiously as possible but positively within a period of eight weeks from the date of receipt of a server copy of this order.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
