It is a fact that in executing the search warrant, the police authority has sealed the residential house of the petitioner.

Learned counsel for the State submits that the police visited the petitioner at Bengaluru pursuant to the search warrant issued against him, but the petitioner did not cooperate with the police authority.

The petitioner denies and disputes such allegation. Be that as it may, since the police authority had no authority to seal residential house of the petitioner in the garb of execution of search warrant, the said house be de-sealed within 7 days from date upon intimation to the petitioner in order to allow access of the petitioner thereto. In doing so, the police authority shall be at liberty to execute the search warrant in accordance with law.

With the aforesaid observations and directions, the writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
