The accusations made by the present petitioner are against his three sons. The petitioner alleges that he has been assaulted physically and attempted to be killed by his sons but was saved by his neighbors.

It has been contended that in spite of such heinous attempts being made at the behest of the private respondents, no steps have been taken by

the police authorities.

State has submitted a report which speaks that the police authorities on receipt of the information drew up a proceeding being Farakka PS NCR No.

3981 of 2024 dated 08.12.2024 under Sections 351(2) of the BNS.

Having considered that the police authorities have taken steps and the manner in which the petitioner described his grievances in the information submitted to the police authorities, it is presumable that medical documents are available with him. In case, the medical documents are available, the petitioner would approach the jurisdictional Magistrate under Section 175(3) of the BNSS.

The learned Magistrate would, on enquiry, pass specific directions by exercising his/her discretionary powers.

With the aforesaid observations, WPA 29749 of 2024 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate for the petitioner.
