CRIMINAL MISCELLANEOUS JURISDICTION CRM (DB) 4286 of 2024 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure, 1973 / Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, arising out of Lalgola Police Station Case No.678/2024 dated 02.07.2024 under Sections 329(4)/118(2)/117(2)/103(2)/109/303(2)/305/324(4)/3(5) of the BNS, 2023.

1. Apparently, there was free-fight took place between the parties.

2. One person suffered homicidal death in such incident.

3. Police filed charge-sheet.

4. Petitioners are in custody in excess of 7 (seven) months and 8 (eight) days.

5. Prosecution proposes to examine 39 witnesses.

6. Petitioners also suffered injuries in the incident of assault.

7. Considering such aspects, we grant bail to the petitioners.

8. Accordingly, we direct that the petitioners, namely, Rentu Sk. & Kokil Sk. @ Ruhul Amin shall be released on bail upon

furnishing a bond of Rs.10,000/- (Rupees Ten Thousand), with two sureties of like amount each, one of whom must be local, to the satisfaction of learned A.C.J.M., Lalgola, Murshidabad. The petitioners shall appear before the trial Court on each and every date of substantive hearing subject to the provisions of Section 317 of the Code of Criminal Procedure, 1973 / Section 355 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever.

9. In the event the petitioners fail to comply with any of the conditions stipulated above, the trial Court shall be at liberty to cancel the bail in accordance with law without further reference to this court.

The application for bail being CRM (DB) 4286 of 2024 is, thus, disposed of.
