However, the notice was received by two witnesses and the appellant was informed by service of notice over telephone, let the said report be kept with the record. The report submitted by ASI Kotwali PS, District Jalpaiguri, stated that the opposite party namely, Ranjit Chakraborty has expired on 16.2.2022 supported by a copy of the death certificate, let the said report be kept with the record.

The instant appeal was instituted by the appellant against an order of acquittal in favour of the opposite party. Since the opposite party has already expired, the instant appeal gets abated and accordingly, disposed of.
