The North Bengal State Transport Corporation & Ors.

Mr. Sufi Masih Aftab ..for the petitioner Mr. Amal Kumar Sen Mr. Sabyasachi Mondal ..for NBSTC Affidavit of service filed in Court today is taken on record.

The petitioner who was an employee of North Bengal State Transport Corporation (in short 'NBSTC') claims to be entitled to the second Career Advancement Scheme (in short 'CAS') benefit during his service tenure, but has been deprived of the same though similarly placed employees have received such second CAS benefit.

The petitioner says that he has repeatedly ventilated his grievances by submitting representations to his employer (NBSTC), but such representations have remained unaddressed and as such the issue remains unresolved.

After hearing the parties and considering the materials on record, I direct the respondent no.2 to dispose of the representation of the petitioner dated

September 23, 2023 which appears at page 38 of the writ petition by a reasoned order within a period of two months from the date of communication of a server copy of this order without insisting upon production of a certified copy thereof. The petitioner, if necessary, shall be given a personal hearing.

Nothing further remains to be adjudicated. The writ petition is accordingly disposed of.

Since I have not called for affidavits, the allegations contained in the writ petition are deemed to have not been admitted by the respondents.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
