Report submitted by the State is taken on record. Heard learned counsels for the parties.

The petitioner has been served a notice under Section 35 (3) of the BNSS. The only prayer of the petitioner is for extension of time of the said notice in order to enable him to appear before the investigating officer in response thereto.

It appears that the notice under Section 35(3) of the BNSS was issued upon the petitioner on 25th February, 2025. However, since the petitioner seeks to comply with the said notice, the petitioner is directed to comply with the same within seven days from date.

In the event the petitioner fails to appear before the investigating officer within the said period, the investigating officer shall be at liberty to take necessary steps in accordance with law.

The writ petition is disposed of accordingly. There shall, however, be no order as to costs.

Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
