Matter relates to transfer of the petitioner since the petitioner is suffering from ailments. Application for transfer was made through Utsashree Portal on 27.12.2022 and same was processed by the school authority where the petitioner is presently working and was forwarded to the concerned District Inspector of Schools (SE) for taking further steps. The District Inspector of Schools (SE) in his turn has processed the transfer application of the petitioner and forwarded the

same through portal on 19.01.2023 to the West Bengal Central School Service Commission for final decision. Grievance of the petitioner is that in spite of receipt of transfer application far back on 19.01.2023, the Commission has not decided the same.

The respondents are represented by learned Advocates who have jointly submitted that contemporaneously transfer application could not be decided due to suspension of portal.

It is submitted on behalf of the West Bengal Central School Service Commission that the transfer application of the petitioner can be decided in accordance with law. Having considered the submissions made on behalf of the parties, the writ petition stands disposed of directing the Chairman, West Bengal Central School Service Commission, being the respondent No.3, to decide transfer application of the petitioner by 8 weeks from the date of communication of this order and the decision to be communicated to the petitioner by one week thereafter.

It is made clear that transfer application of the petitioner shall not be rejected due to suspension of portal.

There shall be no order as to costs.

Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of all requisite formalities.
