The State of West Bengal Mr. Saumik Ganguly Mr. Dilip Kumar Sadhu ...for the Petitioners This is an application wherein the petitioners have prayed for expeditious disposal of G.R. case no. 181 of 2022, presently pending before the learned Judicial Magistrate, 3rd Court, Katwa.

It is submitted on behalf of the petitioners that the petitioner no. 1 is a army personnel and though the proceeding was initiated in the year 2022 and the charge was framed in the month of October, 2022 but out of nine witnesses, only two witnesses have been examined so far and the court is lying vacant and for which, the trial is deferred. Accordingly, he prayed for a direction upon the court below or Judge-in-charge in the court below for expeditious disposal of the aforesaid criminal proceeding since the petitioner no. 1 and other petitioners are suffering a lot due to abnormal delay caused in disposal of the case.

Having heard learned counsel for petitioners it appears that the prayer made by the petitioners is innocuous and if it is allowed in terms of the prayer, the opposite party will have no

cause to prejudice and as such, the service of copy of the application upon the opposite party is dispensed with. Since the prayer made by the petitioners is justified in terms of the long pendency of the proceeding, the instant application being CRR 5520 of 2025 is hereby disposed of with a direction upon the court of learned Judicial Magistrate, 3rd Court, Katwa or Judge-in-charge of the court below to make every endeavour for expeditious disposal of the aforesaid G.R. case no. 181 of 2022, presently pending before the learned Judicial Magistrate, 3rd Court, Katwa and also to make his best effort to conclude the trial preferably within a period of six months from the next date of hearing.

This order is passed invoking this court's jurisdiction under Section 529 of the BNSS.
