The petitioner is the Secretary of Sri Sri Hanuman Ji Puja Committee at Panskura, Purba Medinipur and submits that the committee intends to organise the annual puja celebration and also host a cricket tournament and cultural programme from 20th December to 25th December, 2025 on the land of the private respondents. The private respondents have issued a no objection to the committee. The committee has obtained permission from the electrical department and other required authorities for the programme.
Learned counsel for the private respondents submits that they issued a no objection to the committee and have no objection if the committee organises the programme in their land.
Learned counsel for the State submits that the land in question is a huge stretch of land and it is difficult to identify the exact portion owned by the private respondents. A complaint has been lodged before the police
authority by certain local villagers alleging that the proposed venue of the programme is adjacent to their land. Since the petitioner intends to organise the annual puja celebration, cultural programme and cricket tournament in the land of the private respondents, the said land shall be demarcated in presence of the petitioner, the private respondents, the Sub-Divisional Officer and the Inspector in Charge, Panskura Police Station being respondent nos. 6 and 8 respectively by tomorrow. The Sub-Divisional Officer shall take into consideration any objection raised by any person concerned with the said land.
The programme shall be held from December 20 to December 25, 2025 subject to requisite clearances from the relevant authorities. The microphones will be used in the programme in accordance with the relevant laws. The programme shall not cause disturbance to any neighbour/villager or member of the public. The temporary structures erected for the programme shall be removed within twenty-four hours of completion of the programme and the place shall be restored to its original position. It appears that the police administration has agreed to extend full cooperation subject to compliance with all formalities. The police authority shall keep strict vigil in the area and shall deploy adequate number of police personnel in order to ensure that no untoward incident happens and the programme is held smoothly and peacefully. The committee shall furnish the names of at least five
volunteers along with contact details who shall be responsible in the event of occurrence of any untoward incident during the programme.
With the aforesaid observation and direction, the writ petition is accordingly disposed of.
There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
