Learned Lawyer appearing for the appellant, Cholamandalam MS General Insurance Co. Ltd. submits that the Insurance Company has already paid the awarded amount to the claimants. Learned Lawyer submits that the appellant does not want to proceed with the appeal and the appeal be dismissed for non-prosecution.

Since the awarded amount has been paid to the claimants and the appellant does not want to proceed with the appeal, the appeal may be dismissed for not prosecution. Accordingly, the appeal along with the connected application is dismissed for non-prosecution. Written instruction filed on behalf of the appellant is kept on record.

The appellant is permitted to withdraw the statutory deposit of Rs. 25,000/- and interest accrued thereon from the Office of the learned Registrar General. ( Rabindranath Samanta, J.)
